     Employment of persons who are not U.S. citizens, Lawful Permanent Residents, or in a category of admission that specifically provides for employment authorization is prohibited and an employer who knowingly hires such an unauthorized person is subject to "employer sanctions" ranging from fines to criminal prosecution. In the very recent past, Immigration and Customs Enforcement (ICE) agents have conducted a number of "workplace raids" resulting in the detention of significant number of "unauthorized" workers, eventual deportation and separation of families and of parents from children.

     Many unauthorized workers utilize fraudulent or fake documents and present these to the potential employer as evidence of work authority. This practice undermines the entire system, has a negative impact on the security of this country, consumes law enforcement resources and ultimately hurts the alien who uses those documents and may spoil an otherwise perfect opportunity to gain legal status.

     Worse is the fraudulent use of legitimate documents belonging to another person who is authorized to work, whether because of U.S. citizenship or legal employment status. This unlawful activity is identity theft, which according to ICE officials, will be prosecuted under a specific criminal statute, which results in a two year minimum sentence if convicted.

     States are grappling with their own immigration issues, and frustrated with the response of the federal government, are enacting statutes that give them direct control over crimes committed by aliens. Identity theft statutes provide a means by which States can attack the use of fraudulent documents and avoid immigration law entanglement.

     
The victim of identity theft lives a nightmare and is hounded by his creditors and the IRS, and it stands to reason that if his identity is subsumed by an alien, then he will lose sympathy for the plight of the undocumented worker, resulting in an erosion of support for any positive legislation.
