I Want to Hire Foreign Workers

    

 Congress exercises exclusive control over immigration and legislates with specific objectives, as reflected in the 1952 revision to the Immigration Act that focused on protecting American workers. 
     This core principle is expanded in the 1965 Immigration Act, setting numerical limits and linking the entry of employment related immigrants to a certification that the labor market would not be adversely affected nor would American jobs be lost.
     The Amendments of 1976 and the Immigration Act of 1990 (IMMACT 90) embraced this protection of American workers and foresaw an expanding global economy that would ultimately put significant pressure on American jobs unless America became highly efficient. This required a balance between protection and competence, accomplished in part by expanding the number of employment based categories (competence) and stringent limits on those categories (protection).
     The result is a mixed blessing. The American worker has been protected to an extent, the numerical limits are choking American competitiveness to the point that jobs are exported as a means of achieving efficiency, many jobs are unfilled, employers are scrambling to find workers, and workers are facing shrinking benefits, all due in part to continuous high production costs.
     The American employer is thus thoroughly disadvantaged in that he does not have a sufficient pool of authorized workers to fill his work force, ultimately the consumer does not get the value for his dollar and in the long run, America cannot compete in the global economy.
     The reality, whether we like it or not, is that there exists a labor pool of aliens not authorized to work who will fill those jobs and this breeds unscrupulous persons who manufacture fraudulent employment documents, ultimately creating havoc for law enforcement and businesses, victimizing workers and endangering our national security.
     A rational solution is to enhance the pool with authorized workers who compete for the jobs, are paid a decent wage, pay their fare share of taxes, contribute financially for the social services consumed, are properly socialized into the American way of life and adopt American core values. This protects the worker protects America, favors law enforcement and conserves financial resources.
     We have instead an irrational solution; backlogs in the legal immigration process, so we can't move forward.
     As stated initially, congress legislates with specific objectives; it is currently feeling the pressures and reacting to the debate over the current problematic immigration policy. 
     One measure, "Immigration Reform" is generating tremendous interest because it may address the more complex issue, i.e. comprehensive immigration. The impact on American workers, the expansion of the world economy and America's share of that economy is dependent on getting it right.

     In the meantime employers have to make good choices.
